In so many legal practices today you may never speak to or see an attorney until you are already in court or sitting down to do a closing. Many of these practices use paralegals and non-legal staff to communicate and meet with clients. We are not that type of law firm. Caldwell Law, P.C. is a solo practice, where I strive to devote as much time to each client in person or over the phone to make sure you are heard and understood. When entering the office you will be meeting with an attorney, as opposed to a paralegal, who will listen to what you are needing and give the advice that is necessary. E-mails and phone calls to Caldwell Law, P.C. will always be returned by an attorney, as opposed to non-legal staff. Caldwell Law, P.C. is the place to go when you want an attorney who cares and will communicate in a timely manner.
An estate is the legal term used to describe everything that you own at the time of your passing. Caldwell Law P.C. can speak with you about your wishes and help walk you through all of your options with planning your estate. Depending on what you want done will be critical on what type of documentation will need to be prepared. Having a Will or other documentation prepared before passing will help ease the burden on your loved ones. The pain and heartache that family members face when losing a loved one is only compounded more if there is not something in place to show what you want to happen after you are gone.
When a loved one passes and has assets still in their name, most of the time you must go through the Probate Court process. Probate Court is the court system that handles the process of appointing someone over your estate. The process requires specific forms to be completed and filed with Probate Court in a timely manner. The process also requires certain individuals (i.e. the heirs of your estate) to be notified of your passing and if you had a Will. So many people do not know which forms are the correct ones to file in each estate or who are legally entitled to receive notice. In the many years of handling estates, Caldwell Law P.C. has acquired the expertise needed to make the Probate process as easy and economical as possible for you.
A deed is necessary whenever you want to transfer land from one person to another person. Caldwell Law, P.C. handles deed preparations, recordings and title searches. Simple deed preparations are usually the only thing needed when transferring property to a loved one, transferring property from an estate that has been probated, splitting a property into multiple tracts, transferring property to someone that has already paid you for the property (i.e. cash sales), or transferring property pursuant to a court order such as a divorce decree. However, Caldwell Law, P.C. does not handle formalized closings.
Divorce cases are very straightforward when it comes to how the law works. The different in each case, however, is the assets involved, if minor children are part of the marriage, and whether the soon to be ex-spouses can come to an agreement. Most GA divorce cases will resolve with an agreement between the spouses; however, the longer it takes to reach an agreement the more expensive the divorce becomes. Caldwell Law, P.C. strives to keep the cost down as much as possible and will be very upfront with the likely outcome of the case. Whether you decide to proceed with the case contested (i.e. no agreement at the start) or uncontested (i.e. agreement at the time the divorce is filed) will be the primary factor in price.
Caldwell Law, P.C. recognizes that sometimes all you need is to sit down with an attorney for a few minutes to see what you need to do in a particular legal situation or to go over legal paperwork. Caldwell Law, P.C. offers these general legal topic consultations for 45 minutes at a time for a $50 fee.
As a general practice law firm and smalltown attorney, Caldwell Law, P.C. can handle many other areas of practice outside of the ones listed above. If you need assistance in a legal area that is not listed, then please call Caldwell Law, P.C. We would be happy to speak with you and see if we could assist you in the matter.
